The Company does not own, operate, control, or hold any rights over any Third-Party Tool. Each Third-Party Tool is subject to its own terms of service, privacy policy, pricing, and usage restrictions, which are entirely independent of these Terms.

  • Any subscription, fee, or cost associated with using a Third-Party Tool is your sole responsibility and is separate from the Programme fee.

8. No Affiliation or Endorsement

The Company is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party AI tool, platform, company, or brand discussed or demonstrated in the Programme, unless explicitly stated in writing.

Any product names, logos, trademarks, or brand names of third parties mentioned in the Programme are the property of their respective owners and are used for identification and educational purposes only. Such references do not imply any relationship, partnership, or endorsement between the Company and the third party.

9. Educational Purpose and No Professional Advice

All Content provided as part of the Programme is for educational and informational purposes only. The Programme is designed to teach practical skills in the use of AI tools for professional and personal productivity.

Nothing in the Programme constitutes, and should not be relied upon as, legal advice, financial advice, investment advice, tax advice, medical advice, or any other form of professional advice. The Company is not a licensed legal, financial, medical, or professional advisory firm.

The Company makes no representation or warranty that the skills, tools, or techniques taught in the Programme will result in any specific outcome, including increased income, employment, business success, or any other measurable result. All outcomes depend entirely on the individual efforts, circumstances, and decisions of the Student.

Any examples of results, income, or outcomes shared during the Programme are illustrative only and are not guarantees of similar results for any Student.

10. Community Guidelines and Code of Conduct

Access to the Community is a privilege and not a right. The Company reserves the right to restrict, suspend, or permanently remove a Student's Community access at any time for violation of these Terms or Community guidelines, without prior notice and without any obligation to provide a refund.

  • Treat all other participants, mentors, and the Company's team with respect and professionalism;

  • Not use the Community to promote, advertise, or sell any product or service without the Company's express written permission;

11. Fees, Payment, and Refunds

All fees for the Programme are as displayed on the TagMango platform at the time of enrollment. The Company reserves the right to change Programme fees at any time, but any change will not affect enrollments already completed at the previous price.

All payments are processed exclusively through the TagMango platform. The Company does not accept payments through any other channel.

Refunds, if applicable, are governed exclusively by the Company's Refund and Cancellation Policy, which is published on the Company's website and incorporated into these Terms by reference. Students are advised to read the Refund and Cancellation Policy carefully before enrolling. Nothing in these Terms constitutes a representation that all fees are non-refundable; the Refund and Cancellation Policy sets out the applicable conditions.

In the event of any conflict between these Terms and the Refund and Cancellation Policy on the subject of refunds, the Refund and Cancellation Policy will prevail.

12. Suspension and Termination of Access

The Company reserves the right to suspend or permanently terminate a Student's access to the Programme, the Community, and all associated resources at any time, without prior notice and without any obligation to provide a refund, in any of the following circumstances:

A Student who has had their access terminated may not re-enroll in the Programme or any other programme offered by the Company without the Company's prior written consent.

13. Disclaimer of Warranties

The Programme and all Content are provided on an "as is" and "as available" basis, without any representation or warranty of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, the Company expressly disclaims all warranties, including but not limited to:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement;

  • Any warranty that the Programme will be uninterrupted, error-free, or free from viruses or other harmful components;

  • Any warranty regarding the accuracy, completeness, reliability, or suitability of the Content for any particular purpose;

  • Any warranty that the skills or knowledge acquired from the Programme will lead to any specific employment, income, or business outcome.

The Company does not warrant that the TagMango platform will be continuously available or free from technical errors. Any interruptions in platform availability are outside the Company's control and do not entitle the Student to any remedy.

14. Limitation of Liability

To the fullest extent permitted by applicable law, the Company's total aggregate liability to a Student for any claim arising out of or in connection with these Terms, the Programme, or the Content, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fees actually paid by that Student for the Programme in the 12 months preceding the event giving rise to the claim.

In no event will the Company be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of income, revenue, profits, or business opportunities;

  • Loss of data or information;

  • Loss of goodwill or reputation;

  • Any loss arising from the Student's use of or reliance on Third-Party Tools;

  • Any loss arising from the unavailability, interruption, or discontinuation of the TagMango platform;

  • Any loss arising from changes to Programme content, schedule, or delivery personnel.

This limitation of liability applies even if the Company has been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its directors, officers, employees, agents, licensors, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Programme or Content;

  • Your violation of any provision of these Terms;

  • Your violation of any applicable law or regulation;

  • Your infringement of any intellectual property or other rights of any person or entity;

  • Any content or information you submit, post, or transmit through the Community or the Programme platform;

  • Your use of any Third-Party Tool.

The Company reserves the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with the Company in asserting any available defences.

16. Student-Generated Content

Where you submit any content to the Community or any part of the Programme platform (including questions, comments, assignments, feedback, or other contributions), you grant the Company a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt such content for the purposes of operating and improving the Programme.

You represent and warrant that any content you submit does not infringe any third-party intellectual property rights, is not defamatory, unlawful, or offensive, and that you have all necessary rights to grant the licence described above.

The Company is not obligated to review, approve, or publish any Student-generated content and may remove any content at its sole discretion without notice or liability.

17. Programme Modification

The Company reserves the right to modify, update, restructure, add to, or remove any part of the Programme at any time, including changes to module content, delivery format, session schedules, mentors, Third-Party Tool references, platform features, and any other aspect of the Programme, without prior notice to Students.

Such changes will not constitute a breach of these Terms and will not entitle the Student to a refund, unless the Programme is entirely and permanently discontinued and no equivalent alternative access is offered, in which case the Company will determine an appropriate remedy at its discretion.

The Company will use reasonable efforts to ensure that the core educational content of the Programme remains available and relevant during a Student's period of access.

18. TagMango Platform

The Programme is hosted exclusively on the TagMango platform. TagMango is an independent third-party platform and is not an agent, partner, or representative of the Company. TagMango's own terms of service and privacy policy apply to your use of the TagMango platform independently of these Terms.

The Company is not responsible for and has no control over any aspect of the TagMango platform, including its availability, technical performance, payment processing, account management features, or changes to its terms or policies.

Any technical issues, account disputes, or payment issues relating to the TagMango platform itself must be raised directly with TagMango. The Company will provide reasonable assistance in such matters but cannot guarantee outcomes relating to TagMango's independent operations.

19. Privacy

The collection, use, and protection of your personal data in connection with the Programme is governed by the Company's Privacy Policy, which is published on the Company's website and incorporated into these Terms by reference. By enrolling in the Programme, you consent to the collection and use of your personal data as described in the Privacy Policy.

20. Force Majeure

The Company will not be in breach of these Terms and will not be liable for any delay or failure in performing its obligations under these Terms if such delay or failure results from circumstances beyond the Company's reasonable control, including but not limited to acts of God, government action, regulatory intervention, natural disasters, pandemics, civil unrest, fire, flood, power outages, or failures of telecommunications or platform infrastructure attributable to TagMango or third-party providers.

In such circumstances, the Company will use reasonable efforts to resume its obligations as soon as practicable and may, at its discretion, offer affected Students an extension of access in lieu of any other remedy.

21. Consumer Rights

These Terms do not exclude or limit any rights you may have under the Consumer Protection Act, 2019 (India) and the rules thereunder, or any other mandatory applicable law. Where any provision of these Terms is inconsistent with a mandatory right you have under applicable Indian law, that law will prevail to the extent of the inconsistency.

Students who wish to raise a consumer dispute may contact the Company in the first instance at support@thecuttingedge.academy. If the dispute is not resolved, you may file a complaint through the National Consumer Disputes Redressal Commission portal at edaakhil.nic.in or contact the National Consumer Helpline at 1800-11-4000.

22. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms, the Programme, or the Content that cannot be resolved through good-faith negotiation between the parties shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Students are encouraged to contact the Company at support@thecuttingedge.academy to seek resolution of any dispute before initiating legal proceedings.

23. Changes to These Terms

The Company reserves the right to amend or update these Terms at any time. Any changes will be published on the Company's website and will be effective from the date of publication. It is the Student's responsibility to review these Terms periodically.

Continued access to or use of the Programme following the publication of updated Terms constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease accessing the Programme and may submit a refund request in accordance with the Refund and Cancellation Policy, subject to the eligibility conditions set out therein.

Changes to these Terms will not apply retrospectively to disputes already in progress at the time of the change.

24. Entire Agreement

These Terms, together with the Company's Privacy Policy and Refund and Cancellation Policy, constitute the entire agreement between the Company and the Student with respect to the Programme and supersede all prior representations, agreements, and understandings, whether written or oral, relating to the same subject matter.

In the event of any conflict between these Terms and any other document, the following order of precedence will apply: (1) the Refund and Cancellation Policy, in respect of refund matters; (2) the Privacy Policy, in respect of personal data; (3) these Terms, in respect of all other matters.

25. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from these Terms and will not affect the validity and enforceability of the remaining provisions, which will continue in full force and effect.

26. Waiver

No failure or delay by the Company in exercising any right under these Terms will constitute a waiver of that right. A waiver of any breach of these Terms will not be construed as a waiver of any subsequent breach.

The Company reserves the right to suspend or permanently terminate a Student's access to the Programme, the Community, and all associated resources at any time, without prior notice and without any obligation to provide a refund, in any of the following circumstances:

  • The Student breaches any provision of these Terms;

  • The Student engages in any prohibited conduct as described in Section 6;

  • The Student violates the Company's intellectual property rights as described in Section 5;

  • The Student provides false or fraudulent information to the Company at any time;

  • The Student's conduct is deemed by the Company to be harmful to other Students, mentors, or the Company's reputation or operations;

  • The Student fails to pay any fees due under these Terms or under any installment arrangement.

Where access is terminated by the Company under this section, no refund will be issued. The Company will not be liable for any loss or damage arising from such termination.

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement;

  • Any warranty that the Programme will be uninterrupted, error-free, or free from viruses or other harmful components;

  • Any warranty regarding the accuracy, completeness, reliability, or suitability of the Content for any particular purpose;

  • Loss of income, revenue, profits, or business opportunities;

  • Loss of data or information;

  • Loss of goodwill or reputation;

  • Any loss arising from the Student's use of or reliance on Third-Party Tools;

  • Any loss arising from the unavailability, interruption, or discontinuation of the TagMango platform;

  • Your use of or access to the Programme or Content;

  • Your violation of any provision of these Terms;

  • Your violation of any applicable law or regulation;

  • Your infringement of any intellectual property or other rights of any person or entity;

  • Any content or information you submit, post, or transmit through the Community or the Programme platform;
